1. General Use & Disclaimer

Cash Out Pawn & Guns ("we," "us," or "our") operates a licensed pawn and firearms dealership located at 4581 N Dixie Hwy, Pompano Beach, FL 33064. These Terms & Conditions govern all transactions, interactions, and use of our website and in-store services.

All information provided on this website is for general informational purposes only. While we make every effort to ensure accuracy, we make no warranties — express or implied — regarding the completeness or reliability of any information presented.

• You must be at least 18 years of age to conduct any transaction with us.
• Valid, government-issued photo ID is required for all transactions.
• All transactions are subject to Florida state law and applicable federal regulations.
• We reserve the right to decline any item for appraisal, purchase, or pawn without explanation.

2. Pawn Loan Terms

Pawn loans are short-term collateral-based loans governed by the Florida Pawnbroking Act (Chapter 539, Florida Statutes). By accepting a pawn loan, you agree to the following:

• Loan amounts are determined by our staff based on fair market value and condition of the item.
• A pawn ticket will be issued at the time of the loan. Keep this ticket — it is required to reclaim your item.
• The standard loan period is 30 days, with a grace period as required by Florida law.
• Finance charges and fees are disclosed at the time of the transaction and comply with Florida statutory limits.
• If a loan is not redeemed or renewed by the maturity date (including applicable grace period), the item becomes the property of Cash Out Pawn & Guns and may be sold.
• Items pledged as collateral must be owned by the customer free and clear. Pledging stolen or encumbered property is a criminal offense.
• We are required by law to hold all pawned items for a minimum holding period before resale.

3. Firearms Transactions

Cash Out Pawn & Guns is a federally licensed firearms dealer (FFL). All firearm sales, transfers, and transactions are conducted in strict compliance with federal, state, and local laws, including the Gun Control Act of 1968 and Florida Statutes.

• You must be 21 years of age to purchase a handgun, and 18 years of age to purchase a long gun (rifle or shotgun).
• Valid, government-issued photo ID is required for all firearm transactions.
• Florida law imposes a 3-day waiting period on all firearm purchases (with limited exceptions).
• All FFL transfers require proper documentation. The buyer is responsible for ensuring the firearm is legal to own in their jurisdiction.
• Consignment firearms are sold on behalf of the owner; terms are agreed upon at the time of consignment.
• All sales are final on firearms once a background check is completed and the transfer is approved.
• We do not sell firearms to prohibited persons as defined under 18 U.S.C. § 922(g).

4. Buy & Sell Policy

When selling items to Cash Out Pawn & Guns, you represent and warrant that you are the lawful owner of all items and that they are free from any liens, claims, or encumbrances.

• Valid photo ID is required for all sell transactions. Your information is reported to local law enforcement as required by Florida law.
• We are required by law to hold purchased secondhand goods for a minimum period before resale.
• Offers made for items are at the sole discretion of our staff based on current market conditions and item condition.
• All sales to customers are final. No returns or refunds unless the item is found to be materially misrepresented at the time of sale.
• We are not responsible for verifying the authenticity of luxury goods, collectibles, or branded items beyond our standard assessment.
• Selling stolen property to a pawnbroker is a felony under Florida law. All items are subject to verification with local law enforcement databases.

5. Privacy & Data

We collect personal information (including name, address, date of birth, and ID number) as required by Florida law for all pawn and secondhand dealer transactions. This information is:

• Stored securely and used solely for transaction records and legal compliance.
• Shared with local law enforcement as required under Florida Statutes Chapter 539.
• Never sold or shared with third parties for marketing purposes.
• Retained for the period required by applicable law.

Our website may use cookies or basic analytics to improve user experience. No personally identifiable information is collected through our website without your consent.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Cash Out Pawn & Guns shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website.

While we take reasonable precautions to secure pawned items in our possession, our liability for loss or damage to collateral items is limited to the appraised loan value at the time of the pawn transaction.

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from transactions or use of our services shall be subject to the exclusive jurisdiction of the courts located in Broward County, Florida.

We reserve the right to update or modify these Terms & Conditions at any time without prior notice. Changes will be effective immediately upon posting to our website or display in our store. Your continued use of our services following any changes constitutes your acceptance of the revised terms.
